1. Acceptance of Terms

By creating an account, accessing, or using Stand Map’s services, you agree to comply with and be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree with these terms, you may not use our services.

2. Description of Service

Stand Map is a community-driven platform that helps users discover and share information about local farm stands, farmers markets, roadside stands, and similar vendor locations. Our services include:

• Searchable directory of vendor locations
• User reviews and ratings
• Interactive maps and location information
• Community contributions and gamification features
• Mobile and web applications

3. User Accounts

Account Registration

To access certain features of Stand Map, you must create an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Account Eligibility

You must be at least 13 years old to use Stand Map. By using our services, you represent that you meet this age requirement.

4. User Content and Conduct

User-Generated Content

You may submit reviews, ratings, photos, comments, and other content (“User Content”) to Stand Map. By submitting User Content, you:

• Grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content on our platform
• Represent that you own or have the necessary rights to the content
• Represent that the content does not violate any third-party rights
• Take full responsibility for the content you post

Prohibited Conduct

You agree not to use Stand Map to:

• Post false, misleading, defamatory, or fraudulent information
• Post reviews for your own business or competitor businesses
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Harass, threaten, or abuse other users or vendors
• Post spam, advertisements, or promotional content
• Upload viruses, malware, or malicious code
• Attempt to gain unauthorized access to our systems
• Scrape, data mine, or harvest data from the platform
• Impersonate another person or entity
• Manipulate reviews, ratings, or gamification points
• Use the platform for any illegal or unauthorized purpose

Review Guidelines

Reviews must be based on your genuine experience with a vendor or location. Reviews must:

• Be honest, fair, and based on personal experience
• Not contain profanity, hate speech, or discriminatory language
• Not reveal personal information about others
• Not contain promotional content or advertisements
• Be relevant to the location being reviewed

5. Intellectual Property Rights

Stand Map’s Intellectual Property

All content, features, and functionality of Stand Map, including but not limited to text, graphics, logos, icons, images, software, and design, are owned by Stand Map or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use Stand Map for personal, non-commercial purposes. You may not:

• Modify, reproduce, or create derivative works based on our platform
• Reverse engineer, decompile, or disassemble our software
• Remove or modify any copyright, trademark, or proprietary notices
• Use our trademarks or branding without written permission

6. Content Moderation and Removal

Stand Map reserves the right, but has no obligation, to:

• Monitor, review, edit, or remove any User Content
• Suspend or terminate accounts that violate these Terms
• Remove location listings that are inaccurate, duplicate, or inappropriate
• Investigate suspected violations of these Terms
• Cooperate with law enforcement authorities

We do not endorse or guarantee the accuracy of User Content or location information. Users rely on this information at their own risk.

7. Disclaimers and Limitations of Liability

Service “As Is”

Stand Map is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that:

• The service will be uninterrupted, secure, or error-free
• Location information, hours, or contact details are accurate or current
• User reviews and ratings are truthful or reliable
• The service will meet your specific requirements

Limitation of Liability

To the fullest extent permitted by law, Stand Map, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from:

• Your use or inability to use the service
• Unauthorized access to your account or data
• Errors, inaccuracies, or omissions in content or location information
• User Content or conduct of third parties
• Any other matter relating to the service

Indemnification

You agree to indemnify, defend, and hold harmless Stand Map from any claims, damages, losses, liabilities, costs, and expenses (including attorneys’ fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your User Content
• Your violation of any third-party rights

8. Gamification and Points

Stand Map offers a gamification system where users earn points for contributions such as location suggestions, reviews, and verifications. Points and achievement levels:

• Have no monetary value and cannot be redeemed for cash or prizes
• Are provided for entertainment and engagement purposes only
• May be modified, adjusted, or removed at our discretion
• Do not create any contractual or legal obligations

We reserve the right to adjust or remove points for fraudulent activity or violations of these Terms.

9. Third-Party Services and Links

Stand Map may contain links to third-party websites, services, or resources (such as Google Maps). We do not endorse and are not responsible for:

• The content, accuracy, or practices of third-party services
• Any damages or losses caused by third-party services
• The privacy practices of third-party services

Your use of third-party services is at your own risk and subject to their terms and conditions.

10. Termination

We reserve the right to suspend or terminate your account and access to Stand Map at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Any other reason at our sole discretion

You may terminate your account at any time by contacting us or using account settings. Upon termination, your right to use Stand Map will immediately cease, but provisions regarding intellectual property, disclaimers, and limitations of liability will survive.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by:

• Posting the updated Terms on this page
• Updating the “Last updated” date
• Sending email notifications for significant changes (at our discretion)

Your continued use of Stand Map after changes are posted constitutes your acceptance of the modified Terms. If you do not agree with the changes, you must stop using the service and close your account.

12. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of Stand Map shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for violations of intellectual property rights.

13. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Stand Map regarding the use of our services.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
